Terms of Service

1. Eligibility

You must be:

• At least 18 years old, or
• A teacher, school administrator, or student using the platform under supervision or with permission from a school authority.

By using the Service, you represent that you have the authority to bind yourself or your institution to these Terms.

2. Account Registration

To access most features, you must create an account with accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.

If you suspect unauthorized access, notify us immediately at support@nextguro.ph .

We reserve the right to suspend or terminate accounts that violate these Terms or our acceptable use policies.

3. Use of the Service

You agree to use NextGuro only for lawful and educational purposes. You may not:

• Use the Service to upload or distribute harmful, obscene, or unlawful content.
• Attempt to hack, interfere, or gain unauthorized access to our systems.
• Resell, copy, or distribute platform features without permission.

We may suspend or terminate access if we detect misuse or suspicious activity.

4. AI-Assisted Features

NextGuro uses artificial intelligence to assist in creating lesson plans, quizzes, and performance tasks. By using these features, you understand and agree that:

• AI-generated content is for educational assistance only, and you are responsible for reviewing and validating its accuracy before use in class.
• We do not guarantee that AI outputs are error-free, complete, or compliant with all DepEd standards.
• AI processing is performed securely and does not use your data to train external AI systems.

5. Subscription and Payments

NextGuro offers both free and paid plans for individual teachers and schools.

• Billing: Subscription fees are charged according to the plan selected, using PayMongo or other supported payment providers.
• Trials: If you start a free trial, your billing period begins automatically after the trial unless canceled before the end date.
• Renewals: Subscriptions renew automatically unless canceled.
• Refunds: Payments are generally non-refundable except as required by law or due to verified technical issues.

We may adjust pricing or plan features with prior notice.

6. School Accounts and Multi-User Access

For school or institutional plans:

• The designated school administrator is responsible for managing teacher and student accounts.
• All activities under the school account are deemed authorized by the institution.
• Schools must ensure compliance with the Data Privacy Act and applicable DepEd guidelines when sharing student data.

7. Intellectual Property

All content, software, and design of the NextGuro platform are the property of Jeva Technologies OPC or its licensors. You may not:

• Copy, reproduce, or redistribute platform components
• Reverse-engineer or extract source code
• Use our trademarks or brand assets without written consent

You retain ownership of lesson plans, quizzes, and educational materials you create on the platform.

8. Data Privacy

Your use of NextGuro is also governed by our Privacy Policy .

We process data in accordance with the Data Privacy Act of 2012 (RA 10173) and ensure that user information is handled securely and only for legitimate educational purposes.

9. Service Availability

We strive to keep NextGuro available and reliable but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or security reasons without prior notice. We are not liable for any loss or disruption resulting from downtime or technical issues beyond our control.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your account if:

• You violate these Terms or our policies
• You use the Service for fraudulent or abusive purposes
• Required by law or regulation

Upon termination, your access will be revoked, and data may be deleted according to our Privacy Policy.

11. Limitation of Liability

To the fullest extent permitted by law, Jeva Technologies OPC and its affiliates shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of data, revenue, or profits
• Errors or inaccuracies in AI-generated content

Our total liability shall not exceed the amount paid for your subscription in the preceding three months.

12. Indemnification

You agree to indemnify and hold Jeva Technologies OPC, its officers, and employees harmless from any claim, loss, or damage arising from:

• Your misuse of the platform
• Violation of these Terms
• Infringement of any third-party rights through your content or actions

13. Modifications to the Terms

We may update these Terms from time to time. Updated versions will be posted on our website with an updated “Effective Date.” Your continued use of the platform after updates means you accept the revised Terms.

14. Governing Law and Venue

These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved in the proper courts of Cebu City, Philippines.
